Terms of use for FUUGO.NO Publish

1. Purpose and content

The purpose of the FUUGO.NO Publish service is to give authors the opportunity to self-publish works electronically. FUUGO.NO Publiser is run by Peason Consult (organisation number 927084449) and IBEC Publishing. FUUGO.NO is a Norwegian bookstore and print-on-demand online publisher that sells books, digital and downloadable books (ebooks and audiobooks) and other content that is available at all times, including works published through FUUGO.NO Publish. From time to time we will update the Terms. In the event of major changes, we will inform you directly of the update through an email to the email address you provided when registering to use FUUGO.NO Publish. In the following, the user of FUUGO.NO Publish is referred to as “Vendor.” What the Vendor publishes through FUUGO.NO Publish is referred to as “Verk”.

2. Rights

Under the conditions that follow from this agreement, FUUGO.NO grants the Vendor the right to use FUUGO.NO Publish to publish the Work, and the Vendor grants FUUGO.NO the right to produce and distribute the Work on FUUGO.NO and other sites and sales channels which FUUGO.NO cooperates with. The Vendor agrees that the Work will be registered under the ISBN belonging to Ibec Publishing if none is provided by the Vendor. Vendor grants FUUGO.NO and their partners the right to use the image, title or contents in part or in full of the work for marketing purposes.

3. Copyright

The Vendor retains all copyrights to the Work. The Vendor guarantees to have all the rights necessary to legally publish the Work using FUUGO.NO Publish. Publication of e-books, audio books and paper books on FUUGO.NO Publish is only permitted if all involved rights holders have given their consent. If the rights belong to a third party, this must consent to publication. The above applies to all original works or other texts that are protected by copyright. FUUGO.NO is not responsible for a user’s possible infringement of third-party rights. If FUUGO.NO receives notification that the Work infringes the rights of a third party, FUUGO.NO has the right to immediately remove the Work from FUUGO.NO.

4. Sales commission

FUUGO.NO does not charge for the Vendor’s use of FUUGO.NO Publish. FUUGO.NO takes a sales commission of 40% after deducting production cost for paper books. For eboks and audio books, FUUGO.NO takes 40% of the gross sales since there is no production cost. The 40% will cover FUUGO.NO’s expenses for operations, technical development, marketing and customer service. When selling in iOS, there will automatically be a mark-up in the price to compensate for Apple’s commission of 30%

5. Payment of royalties

FUUGO.NO makes payment for royalties two time in a year, May 15 and December 20. FUUGO.NO will have already deducted commission at the time of payment. Amounts below NOK 500 are paid annually.

6. Content and removal of content

FUUGO.NO reserves the right to reject or remove Works that do not meet the quality that users of FUUGO.NO can expect. In addition to this, FUUGO.NO can, without justification, reject or remove content that may seem offensive and is in conflict with FUUGO.NO’s content policy. This applies to the following: • Strongly pornographic material • Racist content • Content that attempts to harm others. In addition, the right to remove or reject content that may contain illegal information or that is otherwise contrary to Norwegian law.

7. Processing of personal data

It is necessary to create a user profile in order to sell e-books through FUUGO.NO Publish. When you create a user profile, you can voluntarily register a range of information about yourself. Some of this information is mandatory. The required information is your name, name and address of the copyright holder of the Work, Author or company name and your e-mail address. In order to receive payment for books sold, the account number and social security number must also be registered. We use your email address to identify your user profile. In addition to this, we record whether you have accepted our terms of use. How FUUGO.NO processes personal data is regulated in FUUGO.NO’s privacy policy.

8. Privacy policy and data controller

FUUGO.NO is responsible for metadata registered in connection with sales on FUUGO.NO Publish and data registered in connection with a user profile, as well as registration of cookies and IP address. The user is responsible for other content that is registered on FUUGO.NO Publish. 
In order to offer you a FUUGO account, FUUGO will collect and process your personal data for administrative purposes. FUUGO processes and protects your personal data and other personal data when you use the services. Personal data that is collected is stored and processed in a safe and secure manner. We have established routines and measures to ensure the integrity, availability and confidentiality of the information in accordance with Section 13 of the Personal Data Act.

9. Choice of law and venue

This User Agreement is governed by Norwegian law. Any conflicts that the parties do not resolve amicably must be submitted to the Bergen district court for decision.

10. Mandatory delivery of your book to National Library

According to the Obligatory Delivery Act, everyone who publishes a book in Norway must send a copy to the National Library. This applies to all book form. The National Library takes care of the books for the future in a secure digital archive and libraries, and they are registered in Norway’s national bibliography.
